RULES
of the
LITTLE PECONIC YACHT CLUB, INC. (as
approved by the board of directors on September 29, 2021) ________________________
The following rules and regulations apply to all Little Peconic Yacht Club,
Inc. (hereinafter “LPYC,” “yacht club” or
“club”) members and their authorized family members and
guests. They are subject to change without notice by order of the LPYC
board of directors (hereinafter, “board” or board of
directors”) which may revoke membership for any failure to
comply. The board of directors may grant exceptions to these rules for
unusual circumstances. ________________________
1. USE OF FACILITIES. Only members in good
standing and their immediate family members (as defined in Rule 6) are
entitled to use club facilities. Guests of members are welcome, but are
not permitted to use members’ boats, the dock, dock slips, beach
stakes, the ramp, dinghies or other club facilities unaccompanied by a
member or a member’s immediate family member.
2. CLUB HOURS. The
LPYC gate and parking lot will be locked between 8:00 P.M. and 7:00
A.M. daily. Any member who requires parking outside these hours must
contact the Commodore.
3. GRANT OF DOCKING ACCOMMODATIONS. The use of a dock slip or beach stake is granted by the board of directors. The board shall grant the use of dock slips and beach stakes according to any fair and reasonable method that is in the best interest of the club
and the club membership.
4. BOAT SIZE. All boats in dock slips must be motorized and not less than 14 feet in length nor more than 24 feet in length, including fixed anchor pulpits, swim platforms, or fixed additions, and are required to have a midship beam no wider than 8 1/2 feet. Both dimensions as per manufacturers' and/or on-site measurements. Boats moored at beach stakes must be under 20 feet in length, including fixed anchor pulpits, swim platforms, or fixed additions, as per manufacturers' and/or on-site measurements. The Board recommends that any LPYC member contact the Commodore PRIOR to the purchase of a new vessel, to insure compliance with the Rule.
5. PROOF OF
ELIGIBILITY FOR DOCKING & MOORING ACCOMMODATIONS. Every member who
has been granted the use of a dock slip or beach stake shall, by April
15 of each year, submit to the secretary a copy of the boat
registration bearing the name of the member or the member’s
spouse. Every member whose mooring is placed by LYPC shall, by April 15
of each year, submit to the secretary a copy of the mooring permit
bearing the name of the member or the member’s spouse. If any
member fails to comply with this requirement or fails to comply with it
within any extended time frame for submission that the board of
directors may grant, or if the registration number of the boat
occupying the assigned slip, stake or mooring does not match the
registration submitted to the secretary, the member shall be given
notice of the defect and a reasonable amount of time to remedy it (to
be determined by the board.) If the defect is not remedied to the
satisfaction of the board, the member’s privileges and membership
are subject to termination at the option of the board. For good cause
in individual cases, the board may grant leave for a member who is
otherwise in full compliance with all club rules to keep a boat that is
not registered to him or her in the slip that he or she is authorized
to use, but only on a temporary basis and in no instance for more than
one season.
6. DOCKING ACCOMMODATIONS ARE GRANTED TO INDIVIDUAL MEMBERS. Any grant
of the right to use a dock slip or beach stake is made to a member,
personally, for use by the member and the member’s immediate
family (defined as spouse, parents, adult children, adult
children-in-law, adult grandchildren, and siblings, provided the family
member resides with the member in the member’s home in
Southampton Shores.) It shall be a violation of these rules for the
member to whom the use of a slip or stake has been granted to lease,
assign or transfer his or her rights in the slip or stake to anyone
else (except in accordance with article 3 of the club bylaws) or to
permit anyone other than the member’s immediate family to use the
slip or stake or any of the club privileges associated with it.
7. USE
OF ANOTHER’S SLIP IS PROHIBITED. A member may not use another
member’s dock slip unless approved by the Commodore.
8. WAITING
LISTS. Separate waiting lists for dock slips and beach stakes shall be
maintained by the Secretary. Only members in good standing shall be
eligible to be on a waiting list. Members on the lists shall be ranked
in seniority based on the dates of their requests to use slips or beach
stakes, with the earliest date of request having the greatest
seniority. The board shall have the authority to manage the waiting
lists according to any fair and reasonable method that is in the best
interest of the club and the club membership.
9. PROCEDURE FOR
ASSIGNING DOCKING ACCOMMODATIONS. Upon the availability of a dock slip
or beach stake, the board shall first offer the use of such slip or
stake to the person having the greatest seniority on the waiting list
for the type of accommodation that has become available; however, preference will be given to persons on the waiting list that do not have a dock on Wooley's Pond associated with their house. The purpose of this preference is to provide more members access to "boating" by providing more members access to docking/mooring facilities. The Board retains the authority to address docking accommodations on a case by case basis. The member shall, within ten days, either accept, decline or defer acceptance of
the offer.
10. ACCEPTANCE OF DOCKING ACCOMMODATIONS. If the member
accepts the offer, he or she shall pay the appropriate dues within 30
days of the offer, unless the offer is made between October 1 and March
1, in which case the member shall pay the dues by the next regular dues
collection deadline. If the dues are not fully paid as required, the
offer shall be revoked and the board shall offer the slip or beach
stake to the person with the next highest seniority on the list and the
member who failed to pay shall be deemed to have declined the offer. If
the accepted offer was made prior to May 4, the member shall occupy the
slip or stake by July 4 in accordance with Rule 13. If the accepted
offer was made between May 4 and May 31, the member shall have a grace
period of two months in which to occupy the slip or stake. If the
accepted offer was made after May 31, the member may take occupancy the
following season without violating Rule 13. If the member fails to
occupy the slip or stake within the required time, the offer shall be
automatically revoked and the board shall offer the available slip or
stake to the next most senior member on the waiting list. The member
who failed to occupy the slip or stake shall be removed from the
waiting list and may be reinstated to the waiting list at his or her
request without seniority. Upon a finding by the board that a member
who accepted the offer is unable, through no fault of his or her own,
to occupy the slip or stake within the prescribed time period, the
board may grant additional time for the member to occupy the slip or
stake or may offer the available slip or stake to the member with the
next highest seniority on the waiting list and permit the member who
failed to occupy timely to maintain his or her seniority on the waiting
list. If a slip of limited capacity is offered and the boat of the
member who accepts the offer is too large, as determined by the
Commodore, to be appropriately accommodated by the slip, the Commodore
may offer the slip to the person with the
next highest seniority on the waiting list and the member whose boat
could not be accommodated shall remain on the waiting list with no loss
of seniority.
11. DECLINATION OF DOCKING ACCOMMODATIONS. If the member
declines the offer, the member’s name shall be removed from the
list and may be reinstated to the waiting list at his or her request
without seniority.
12. DEFERMENT OF DOCKING ACCOMMODATIONS. A member
who is offered a slip or stake may choose to defer acceptance of the
offer, in which case the offer shall be made to the person with the
next highest seniority on the waiting list and the member who deferred
shall be permitted to maintain his or her seniority on the waiting
list. A member may defer no more than two times.
13. FORFEITURE FOR
FAILURE TO OCCUPY. Any member not using an assigned dock slip or beach
stake by July 4th, or by any later occupancy date permitted by the
board under Rule 10, and not maintaining occupancy of the slip or beach
stake continuously through August 20th will forfeit that slip or beach
stake. The board shall have the authority to dispense with this rule in
individual cases in the event that unforeseen circumstances cause a
member who has been granted the use of a slip or beach stake to be
unable to comply with it. However, in no event shall a member be
permitted to retain the use of a slip or beach stake for more than one
season without occupying it.
14. BOAT TIE LINES. Members shall rig
their boats’ tie lines in accordance with LPYC requirements. If
any member fails to conform to the requirements, the LPYC will make the
necessary changes and the member will be responsible for any related
costs. Boats must be equipped with proper fenders to avoid damage to
adjacent boats or the dock.
15. CLUB DINGHY. LPYC dinghies are for the
exclusive use of LPYC members. Dinghies should not be used for any
purpose other than shuttling members between the dock and a mooring.
Each use of a dinghy is limited to no more than fifteen (15) minutes.
16. SERVICE DOCK. The tie-up of unattended boats at the end of the dock
is limited to fifteen (15) minutes.
17. MOORING PLACEMENT. Moorings
must be placed in accordance with LPYC chart markings. By April 1 of
each year, members who use moorings shall have their moorings prepared
for inspection by the Bay Constable and ready for installation. The
Commodore may require members to change a boat’s mooring location
to avoid interference with, and damage to, other boats or impairment of
dock traffic. Violation of this rule will result in the LPYC moving the
mooring or the Bay Constable impounding the mooring with costs and/or
fines to the boat owner.
18. REMOVAL FROM MOORINGS. By order of the
Board of Trustees of the Town of Southampton, all moorings must be
removed before December 1st. The LPYC will arrange for the prepaid bulk
hauling. All moored boats shall be removed from their moorings by
October 31 of each year.
19. REMOVAL FROM SLIPS. Boats shall be removed
from slips by November 15.
20. RELOCATION OF DOCK SLIP OR MOORING LOCATION. Any member wishing to
be relocated either at the dock or at a mooring should submit a request
to do so, in writing, to the club Secretary and the request shall be
voted upon at the next meeting of the board of directors.
21.
RE-ALLOCATION OF DOCK SLIPS. Annually, the board of directors may
reallocate the dock slips on any reasonable and fair basis that is in
the best interest of the club and the membership.
22. JET SKIS. Members
of the LPYC may launch jet skis from the boat ramp. Jet skis must
observe the 5 MPH (no wake) law mandated by the Town of Southampton.
23. BOAT RAMP. Use of the boat ramp is limited to LPYC members in good
standing.
24. TRAILERS. No unattended trailers shall be left in the
parking lot. Same shall be subject to tow at the owner’s expense.
25. LIMIT ON NUMBER OF SLIPS OR STAKES. Because sharing resources and
having consideration for our neighbors is critical to the continuation
of the historically strong community spirit and harmonious coexistence
enjoyed by the residents of Southampton Shores and the members of the
Little Peconic Yacht Club, the board shall not grant docking
accommodation for more than one boat to any member.
26.
COMMODORE’S AUTHORITY TO ENFORCE RULES. The Commodore shall have
the authority to enforce these rules.
